It is for me a pleasure always renewed to accommodate you at the Superior council of audio-visual in this January and to wish you from the start, on my behalf and that of all my colleagues, an excellent year 2017.

We greet the presence of Mister cordially the Secretary of State to the Sports, Thierry Braillard, and let us thank it for so closely associating the Council with his action of promotion of the sport in the audio-visual one, in particular within the framework of the four seasons of the female sport of which we will launch together the new edition in February.

I am also delighted very highly to accommodate the presidents of the charged commissions of the cultural affairs of the National Assembly and the Senate, Catherine Morin-Desailly and Patrick Bloche, like several their appointed colleagues and senators. The Council maintains, through your commissions, a link of an intensity without equal with the national representation. Those have just approved designation by the presidents of your Assemblies of two new members of the college which from now on will count seven of them: Monsieur Jean-François Mary and Mrs Carole Bienaimé Besse with whom I welcome. They succeed our former colleagues Francine Mariani-Ducray, Nicolas About and Patrice Gélinet whom I thank for their commitment during the six years for their mandate, with the service of the institution and of his missions.


More than ever, whereas we test the shock tragic of terrorism, the jolts of the European scene and international, divisions and incomprehension which split up our company, we feel our paramount responsibility: to encourage the economic advancement and technological of audio-visual essential to promotion of our culture, our collective personality and our Rule of law, in a spirit of mutual comprehension and exchange.

France is our heritage, diversity is our challenge, solidarity is our duty.

To answer these requirements, the media play a crucial role to play and in particular the public service of audio-visual, called to reinforce our united actions. Which other access modes to information, the culture, the collective life can have a so strong vocation today to gather that the whole of our radios and our televisions made unceasingly more present and closer by the digital impulse.

To accompany them, our role, as a regulating body, is not to resign us to immutable rules and uniformisatrices, but contrary to us to attach by a dynamic and interactive approach, to emphasize all their achievements and their capacities, to precede and accelerate the evolutions necessary.

And, right now, that of way traversed since four years.

Diversification and enrichment of the programs, worthy of those of the modes of diffusion, opening of the media to all the representations of the image, the sound and the sign, tightening of the chains of value which appear by new alliances patiently tied and gradually consolidated.

To put forward your assets by respecting your singularity, in order to better cope with the challenges of an increasing competition, such appears to us to be the way of our common future.


The year which has been just completed will have been remembered of an increased confidence carried to our institution.

This confidence, it is initially – and I should perhaps say above all – that of the public, televiewers and listeners.

 One never should forget but the law which governs to us makes interest of the public the guiding principle of all the action of the Council. Throughout the year 2016, we did not have of cease there to be attentive and to enrich our relation by proximity. You know it, I never liked this facility of expression which consists in qualifying our Council of “ gendarme of audio-visual ”: I would wish that it be rather felt like the guard of the public ones.

In 2016 the Council developed strongly its presence on the social networks, spaces privileged of dialogue and interactivity in which he took all his place: whereas we receive 8,000 descriptions in 2015, those rose last year with nearly 40,000. This quick change logically materialized by a tripling of the subscribers on our accounts. In order to still mark more this proximity, the whole of the territorial committees of the audio-visual one, of which I greet here work and the implication, also made the choice to be present on these networks.

In the same spirit of opening and transparency, an innovation will have been rightly noticed in particular by the professionals that you are: the Council communicates from now on each week the agenda of its full session.


Confidence of the public but also confidence of the touching legislator through several texts of many fields of the audio-visual regulation.

Three laws, very of parliamentary origin, reinforced the role and the action of the CSA in fundamental fields for the democratic life and national cohesion: methods of exposure in the media of the candidates to the presidential election, the independence of information and the media treatment of the attacks.

Initially, the organic law of April 25th, 2016 of modernization of the rules applicable to the presidential election modified the methods of accounting of the speaking times of the candidates while seeking more effectively to reconcile the exercise of the freedom of communication with the principle of pluralism of the currents of ideas and opinions. It generalizes the competence of the Council to define, within the framework fixed by the law, the criteria making it possible to appreciate the principle of equity, which will also apply from now on to the period which precedes the beginning by the official countryside.

Through the inflections of the recommendation of September 7th, 2016 for the election of the President of the Republic, which he wanted to establish as soon as possible in a preoccupation with a foreseeability, the Council allows a better public apprehension of the modes of expression and political information. The autumn 2016 was also the occasion to found new methods of presentation of the calculations extended to the personalities to which the Council proceeds in order to better, and more regularly, to give an account of our action in this field and to facilitate of it the access and the exploitation by the greatest number thanks to the recourse to open dated.

This year, was also adopted the law aiming at reinforcing freedom, independence and pluralism in the mediums. The year 2016 will have been remembered besides by news charged on this subject, in particular the long strike which the chain of information knew uninterrupted i>télé. We marked our very serious concern with respect to the situation of this chain like that of its journalists and we adopted all measures which the law then enabled us to take, vis-a-vis an unheard of situation. The Council will remain always attached so that this chain offers to the televiewers programming fully in conformity with its convention.

This new law places the Council in a role of mediator and of watchtower of which we measure the major importance well. She entrusts in particular the task to us to introduce, in the conventions concluded with the editors measurements suitable to still guarantee better independence, the honesty and the pluralism of information, by in particular ensuring the follow-up of the committees responsible for the ethical questions.

Lastly, the dramatic events which again struck our country during summer 2016 led the legislator to entrust to the CSA, in the law of prolongation of the state urgently voted in July 2016, the mission of working out, according to the terms then employed, a “ code of good control relating to the audio-visual cover of terrorist acts ”.

The development of this text was characterized by a dialogue frank and opened with the whole of the editors of radio and television, but also with representatives of the journalists, experts, representatives of the victims and by hearing the prosecutor and the vice-prosecutor of the Republic of Paris. The text to which we ended entitled – “ Precautions relating to the audio-visual cover of terrorist acts ” – is thus the fruit of a concerted reflection, and we observed that it had hardly caused opposition, which was far from being acquired in view of the extreme sensitivity of the subject which touches – do not think that can one moment leave our spirit – the basic principle of freedom informing.


This dialogue, which must at every moment nourish the difficult exercise of the regulation, the Council also wished to develop it with the whole of the recipients of the audio-visual sector by creating the “Meetings of the CSA”, a new form of exchanges intended to feed our transverse reflection. The first of these meetings was held on September 27th on the topic of “ the audio-visual one in digital space: platforms and given “and made following the publication by the Council of a study on the same topic.

In the same direction, the college decided to associate the competition of a ' think tank ', the “CSA lab”, which brings together nine experts of digital and audio-visual and has vocation to produce several annual reports. The first of them, devoted to the role of the data and the algorithms in the access to the contents, was published on our site last Friday.

The best test of our expert testimony is naturally a test “on the ground”. And I think that this test was successful, through an operation which will have occupied the teams of the Council day and night, in particular at the time of the night from now on celebrates among us from April 4th to April 5th.  The televiewers can since this date not only profit from the extension to all the metropolitan territory of 15 additional free national chains, but also of local channels diffused in High definition.

As you surely know it, this operation fell under a European and even world movement in progress aiming to identify and allocate for the mobile services of new wavebands. The European Commission committed itself besides last December saving the audio-visual diffusion in its hertzian form at least until 2030.

Following the example of these negotiations concerning the wavebands, the complete apprehension of the movements structural that knows the sector of audio-visual can take place only in one European and international context.

At the conclusion three years of French presence in charge of the ERGA, this grouping gathering since 2014 the regulators of the European Union from now on is looked like an essential partner of the reflections relative to audio-visual at the European level. I want some for proof recovery it of most of our proposals in the draft Directive known as Services of audio-visual mediums, such as integration in his field of application of the platforms of division of videos, the introduction of an obligatory minimum of European works in the catalogues of the video services to the request and the possibility given to the Member States to apply their devices of financing of creation to the services targeting their territory while being established in another country of the European Union.



This international action of the Council will continue intensely in 2017.

It will be concretized first of all by new reflections on the evolutions of the directive. The work undertaken currently at the same time by the European Parliament and the Council of the European Union should succeed at the end of the year and the Council will carry a particularly attentive glance there while taking care to support in this exchange all measurements which seem to him capable to support the vitality of European and French creation. This revised directive will be able to have direction only if she takes into account the enlightened opinions of her principal recipients: editors, distributors, producers, authors and more generally the whole of the actors of the audio-visual sphere. I seize the opportunity which is given to me to launch you, with all, a call: we work on our side, but do not miss the occasion which is given to you to put forward, directly and constantly, by a presence increasingly more attentive, your positions near the European authorities! 

Beyond the borders of the European Union, the Council will have the load this year to accommodate with the autumn, in Marseilles, the 19th plenary assembly of the Network of the Mediterranean authorities of regulation whose I will take over on this occasion the presidency. The purpose of this authority, created in 1997, is to encourage the contribution of the sector of the audio-visual communication to a Mediterranean space of peace and stability. Joining together countries as various as Spain, Portugal, Lebanon, Turkey, Israel, Italy, Tunisia or Morocco, the RIRM attempts to formulate and diffuse the common values of the regulation, being in particular the requirements of respect of the person, warranty of pluralism, and promotion of cultural diversity in the programs.

I do not either only forget, on the international scene, the diffusion of a certain glance on the world which is that carried by our country finds in France Media World a privileged channel. The Council will have in a few months the load important to carry out the nomination, for the five next years, of the president or the president of the company in charge of the audio-visual outside of France.

Moreover and in a general way, be assured that the Council will pay a special attention so that its cooperation actions international as a whole bring a help to the economic dynamism of the French audio-visual sector.


In this spirit, during the year 2017, we will continue to accompany the movements by consolidation and convergence.

We will be in particular brought to pronounce us on the operations of capital intensive modifications, of which some, like the recent approach to carry out the regrouping of their activities of television and radio of the M6 groups and RTL, were already announced. We will have also to know other operations through opinion which we are led to give to the Authority of competition, as it currently re-examination of the injunctions and commitments applicable to the Canal Plus Group is the case. 

Besides the movement of convergence between certain distributors and editors and, overall, reconfigurations of the relations between these two categories of actors ask questions renewed with the Council: he will be thus in charge of fixing, in accordance with the request of the legislator, of new rules as for the classification of the chains.

Vis-a-vis these evolutions, we will be guided by a double concern: on the one hand, not to prevent the emergence or with the development of audio-visual groups of reference, attaches to the radiation of creation and, on the other hand, to preserve the conditions of a competing balance allowing a true diversity of the operators.

A report is essential however: vis-a-vis these increasingly fast evolutions of the sector, vis-a-vis the renewed challenges that we meet, the Council is obstructed by the complexity of the standards that we have to apply. The law of 1986, amended in particular with very many resumptions, fruit of the sedimentation of successive and sometimes divergent inspirations, would deserve, last the venerable age at the thirty years digital age, to be the object of an overall recasting. I already formulated this wish on several occasions. Since a new legislature will begin in June 2017, I launch this appeal again.

To accompany the actors by the sector, we must also continue the development of the networks which constitute the base of their activities. The Council will thus continue its work on the future of the DVB, relating in particular to the improvement of the quality of the image and in particular the possibilities of introduction of services in ultra-high definition.

As regards the radio, with regard to the FM band, the Council will register its mission of attribution of frequencies in a vision moreover long run, futurology, taking better into account the challenges of construction of a denser radiophonic landscape, in the respect naturally of the diversity of the operators and the interest of the public.

As regards the RNT, the Council continues the action right now committed so as to it given and pragmatic time. For the summer 2016, a call for candidate was launched in the three zones of Lille, Lyon and Strasbourg and the selection of the candidatures was carried out at this beginning of year. The calendar of regional deployment will of course be continued. This deployment could be prolonged by a double movement of thickening on the peripheral territories of large metropolises and cover of the motorway and road main roads. The Council will be naturally brought to deliberate on it.

This inspiration answers our position already clearly marked to regard the RNT a complement and not as a substitute of FM.

There remains however still a fundamental aspect of the evolutions in progress, remained until now in fallow. I note day after day, vis-a-vis the many requests whose CSA is the object, that the public pains to understand, in particular vis-a-vis contents considered shocking, which we can intervene in certain cases whereas we are not qualified in others.  Not a day does not do without without we being challenged on our role of protection of the public ones, in particular most fragile, on the digital supports: that are in question the diffusion of pornographic images and matter defending terrorism, the propagation of contrary videos to the human dignity, the diffusion of uncontrolled information, we are often the receptacle of indignations of our fellow-citizens, who have the reflex natural to turn to us.


The public is not besides the only one to challenge us, since the editors rightly complain also “asymmetries” in the regulation which we operate.


You know it, I had alerted the public authorities as of my taking of on this serious economic issue and social. At the time, this concern was initially perceived unfortunately like a claim of competences. Today, more and more frequently, of real and major concerns of most of our fellow-citizens express themselves. The Council is well placed to hear them and understand them.



I will complete these remarks by some more personal words.


We wish you with all, as I marked it from the start, not only professional successes worthy of your efforts but also quite successfully to carry out your personal life, inseparable from that of your close relations, during this year which starts.


For our part, will know that confronted quite naturally with tensions, oppositions, often with regrets, sometimes with dissatisfactions, when we are not able to give satisfaction to all your aspirations, we will continue our task with the acute feeling of its utility, of its need even. We will always endeavour to find a watershed which indicates the direction of progress for more a large number of between you.


Our independence is not extremely fortunately more in question. We will use about it with the constant worry of a rigorous impartiality. You can be persuaded that, throughout this year, with the support qualified and lit collaborators and collaborators of the Council, we will not spare any effort to work with the service of the audio-visual one.


Many examples alas show it beyond our borders, the freedom of communication is not a postulate but a conquest of each day.


With each one and each one among you we wish of any heart an excellent year of creative freedom and personal blooming.
