Opinion of the CSA to the Government

On the whole of the activities concerned with its competence, the CSA can be seized of requests for opinion or studies by the Government, the presidents of the French National Assembly or the Senate and the responsible committees of these two assemblies (Article 18 of the law of September 30th, 1986). It is also asked for an opinion by the Authority of competition on the economic anticompetitive practices and concentrations intervening in the audio-visual sector (Article 41-4 of the law of September 30th, 1986).

The opinions of the CSA are requested by the Government on:

- government bills on the audio-visual one and projects of lawful acts relating to the sector of the audio-visual communication (Article 9 of the law of September 30th, 1986);

- adoption of the obligations relating to in particular publicity with the radio and on television, the diffusion of cinematographic works and audio-visual works, the contribution of televisions to the production, as well as the independence of the producers with regard to the diffusers (Article 27 of the law of September 30th, 1986);

- adoption of the provisions of the specifications of the radios and public televisions (Article 48 of the law of September 30th, 1986);

- projects of decrees concerning the definition of the wavebands whose attribution or assignment is entrusted to the Council and those which are allotted to the administrations of the State (L41 Article of the code of the stations and the electronic communications).

- the fixing of the standards relating to equipment and techniques of diffusion or distribution of the services of radio and television; development of the technical specifications applicable to the signals emitted by the radios and televisions using the hertzian way (Article 12 of the law of September 30th, 1986).

These opinions are published in the Journal officiel de la République française.

The CSA is also consulted on the definition of the position of France in the international negotiations on sound broadcasting and television (Aticle 9 of the law of September 30th, 1986).

Lastly, the presidents of France Televisions, Radio France and the company in charge of the audio-visual outside of France are named by decree in the Council of Ministers for five years after assent of the CSA and opinion of the parliamentary commitees in charge of the cultural affairs (article 47-4 of the law of September 30th, 1986 and organic Law n°2009-257 of March 5th, 2009).
