Plenary assembly of October 4th, 2017

The Superior council of audio-visual imposed against association Defense committee of the listeners of Radio Solidarity (CDARS) a pecuniary penalty of an amount of 25,000 euros to be poured with the Treasury, that is to say nearly 3% of his sales turnover (*). It observed that during the emission of March 28th, 2016, the remarks likely to encourage discriminatory behaviors with regard to the people because of their membership of an ethnos group, a nation, a race or a religion had been held. These remarks in addition did not cause any reaction to the antenna tending to moderate them or affix a critical glance there. The Council thus considered that it was a failure characterized with the stipulations of articles 2-4 and 2-10 of the convention of February 8th, 2012 and determined a sanction proportional to the gravity of the facts.

(*) the amount of the pecuniary penalty (article 42-2 of the law of September 30th, 1986) must be a function of gravity of the made failures and in relation to the advantages drawn from the failure, without being able to exceed 3% of the turnover.
