Deliberations and recommendations of the CSA

The Superior council of audio-visual has a general power of recommendation allowing him to clarify the obligations resulting from the provisions of the law of September 30th, 1986 relating to freedom of communication (article 3-1 of the law of September 30th, 1986).

This power of recommendation can cause, in the event of failure with the obligations rising from these texts, formal notices and sanctions envisaged by the law (Article 42 and following and 48-1 and following of the law of September 30th, 1986).

In addition, the CSA holds a sectoral power of recommendation pursuant to certain articles of the law of September 30th, 1986, as as regards pluralism (article 16 of the law of September 30th, 1986) or of placement of product in the programs of the services of television for example (article 14-1 of the law of September 30th, 1986).

Lastly, if the “recommendations” and the “deliberations” of the CSA indicate, from a legal point of view, of the acts comparable obeying with the same mode, the Council preferred to retain the denomination of deliberation in order to raise any ambiguity on their imperative character.
