Obligations of the stations

No service of sound broadcasting must diffuse between 6:00 and 22:30 of programs likely to run up against the sensitivity of the listeners of less than 16 years.

The pornographic programs or of very great violence are, as for them, the object of a total ban of diffusion because of the absence of allowing technical device, for the services of sound broadcasting, to make sure that only the adults can reach it.

These provisions are formalized by the deliberation of February 10th, 2004 relating to child protection and adolescence to the antenna of the services of sound broadcasting.

What makes the Council?

The regulation framework

In accordance with article 15 of the law of the modified September 30th, 1986, the Superior council of audio-visual is guaranteeing child protection and adolescence in the programs put at the disposal of public by a department of communication audio-visual.

The Council must in particular take care that no program likely to harm blooming physical, mental or moral of the minors is not placed at the disposal of the public by a service of sound broadcasting, except when it is ensured by the choice of the hour of diffusion that minors are not normally likely to hear them.

The Council can resort to sanctions (bond towards the point “Sanctions” in the presentation of the council).

In addition to the law and the deliberation of February 10th, 2004, the action of the Council is based on the conventional commitments of the radiophonic services. The conventions, cosignées by the CSA and the stations of private radios, envisage in article 2-12 that these radios will have “to take care of the adolescence and child welfare in the programming of their emissions, in accordance with the deliberation of the higher Council of audio-visual of February 10th, 2004”. Concerning the Radio France company, its specifications provide, with article 5, that “the company takes care of the her dignity and respect for human dignity, of the equality between the women and the men like with the protection of the children and teenagers. She informs the listeners in a suitable form when she programs emissions likely to run up against their sensitivity. »

Methods of control

The CSA does not intervene before diffusion. It examines on the other hand all the complaints addressed by mail or e-mail, since these complaints mention the name of the station and the schedule of diffusion or the title of the program. Systematically, the services of the Council proceed then to the listening of the accused program, write a file if that proves to be necessary and, after examination of this one by the working group in charge of the protection of the minors, the Council rules, in plenary session, on the decisions to be taken.

The Council has also the ability to take the initiative on programs opposite which he questions himself with the glance as of legislative and/or conventional obligations of the radiophonic operators

The definition of the litigious sequences

The majority of the recent interventions of the Council related to remarks relating to the sexuality, evoked in raw and obscene terms; the Council considers that sequences during which stimulating and/or listeners intervening describe in a believed way, detailed and standardized sexual practices are particularly likely to run up against the sensitivity of the minors of less than sixteen years and of this fact do not have to be diffused before 22:30.

Among the other reasons for interventions of the Council, can be also raised the behaviour of matter incentive to violence or being able to cause the fear or the fact of inciting the listeners with practices or behavior delinquents or unpatriotique.
