Use of the device radio operator Flister by the firemen of Paris: prolonged experimentation

The Council authorized the Brigade of the firemen of Paris to be prolonged, for one one year duration, the experimentation of the device radio operator Flister on its vehicles. This device makes it possible to remotely warn the motorists of the proximity of a vehicle of help.

He also alerted the ministry for the interior to draw his attention to the need for framing this device taking into consideration challenge connecting the freedom of communication and the requirement for effectiveness of the help to the victims.

Indeed, although very sensitive to the principle and the finality of this device, in particular whenever the vital prognosis of a victim is engaged, the Council does not have the legal support to authorize of it the use of manner perennial by the Brigade of the firemen of Paris, this alarm system of the individuals on the FM frequencies having for object and effect to scramble the signal of the services of radio. Such an authorization would be likely to ignore the provisions of the article 1st of the law of September 30th, 1986, under the terms of which: “ The communication with the public by electronic way is free ”.

Under these conditions, the Council decided to authorize the continuation of the experimentation only for one duration one year. Only a legislative modification would enable him to authorize, in a perennial way, the exploitation of this device.
