Terms of dissemination of publicity on the SMAD: answer to the plaintiffs

The Council was received complaints relating to the terms of dissemination of the advertisements on the services of audio-visual mediums to request (SMAD): these advertising sequences cannot be avoided at the time of the watching of programs on this kind of audio-visual service.

The Council their answered that the SMAD in question proposing a free access with audio-visual contents, the recourse to publicity takes part not only in the financing and the development of these services, but also in their contribution to the sector of audio-visual and cinematographic creation. It is not possible for the Council to intervene on this practice, the decree of November 12th, 2010 relating to the services of audio-visual mediums to the request not prohibiting the diffusion of publicity imposed on the beginning of the watching and by not limiting the quantity.
