Deontology of information and the programs

The diffusion of images and the specificity of certain televised programs, compared to the radio operator media, led the Council to adopt deliberations relating to only the programs diffused on television.

The framing of the emissions of reality TV

The appearance, in France in 2001, of programs of reality TV consisting in recording, 24 hours a day, the life, the behavior and the relations of a group of people isolated during several weeks from at a stretch, led the Council to put forth a recommendation, on May 14th, 2001, of which the principles were integrated into conventions, aiming so that in front of excessive manner the spirit of exclusion is not put and that are not uttered defamatory remarks or abusive against the participants. The diffusers are held, on the one hand, to permanently put at the disposal of participants a preserved place of any recording and, on the other hand, to envisage daily phases of respite one significant and reasonable duration which causes no sound recording or visual nor with any diffusion. The participants must be clearly informed capacities of the technical device of recording, in particular of the site of the cameras and microphones and their number, infra-red existence of cameras or two-way mirrors. Safety reasons can justify a permanent follow-up of the life of the participants by the persons in charge of the production but without recording nor diffusion.

Prevention against the Sexually transmitted diseases

In addition, in order to protect the public health which is a component of the public order, the Council adopted a deliberation on December 4th, 2007 imposing the port of the condom in the pornographic programs diffused by television services. It was based on the extension risk of sexually transmitted diseases, the pornographic programs not comprising the port of the condom endangering the life of the actors and standardizing behaviors at the risks near the televiewers, in particular the young adults.

The prohibition of the diffusion of the free combat

By a recommendation of December 20th, 2005, the Council moreover intervened to prohibit, on the French territory, the diffusion of combat classified by the organizers under the name of “Free Fight”, “MY” or “free Combat” which are recognized by no national federation, the organization of this kind of engagements on the French soil which has been the object of prohibitions by order of the prefect. As regards demonstrations being held abroad, they must, to be diffused on the French terrritoire, to answer several ethical and sporting criteria.

Financing of emissions by the territorial collectivities

The financing of emissions by the territorial collectivities was the object of a recommendation of January 4th, 2007 which requires of the editors of services concerned the compliance with the following rules, concerning the financed or sponsored emissions: the elements relating to the contents and the programming of the sponsored emission should not be the object of agreements likely to attack the responsibility and to leading independence with the territorial collectivity; the clear identification of the godfather must be made, at the beginning or the end of the emission; in the course of emission, only a specific and discrete mention of the godfather is possible; finally, the presence and the intervention of one or more persons in charge of the territorial collectivity having sponsored the emission are allowed, when they specific and are measured, that the choice of the intervening or evoked persons in charge translated a concern of objectivity, impartiality and pluralism, and that the intervention is not of any political character.

The recourse to the hidden camera

The recourse to the processes making it possible to collect images and sounds unbeknownst to filmed or recorded people must be limited to the needs for the information of the public. It must be restricted with the cases where it makes it possible to obtain information difficult to collect differently. The recourse to these processes must be made available of the public. The people and the places should not be able to be identified, except exception or if the assent of the people were collected prior to the diffusion of the emission.
