Remarks insulting in the emission “standard L'Equipe”: answer to the plaintiff

The CSA was seized by a professional footballer following the diffusion, on April 14th, 2017 on the chain the Team, of a sequence of the emission the standard Team during whom remarks virulent and insulting with connotation homophobe and sexist would have been made with his opposition.

Article 2-2-1 of the convention concluded between the Council and the chain provides that “ the editor is responsible for the contents of the emissions which it diffuses. It preserves in all circumstances the control of its antenna “. In addition, under the terms of articles 2-3-2 and 2-3-4 of this same convention, “ the editor takes care in his program (...) to fight against discriminations ” and “ he respects the rights of the person relative to his private life, its honor and its reputation such as they are defined by the law and jurisprudence ”. 

The Council noted that virulent remarks, even insulting towards the plaintiff, had indeed been made during the emission, and that these remarks stigmatized the homosexual people. During the short sequence during which the speaker could make these remarks, this one was stopped twice by one of the chroniclers who rose against the terms employed with regard to the plaintiff. 

Lastly, the Council took into account the appeal launched by the presenter of the emission, directly after the behaviour of these remarks, tending to adopt a more suitable language and this, whatever the tonality of the program. 

Under these conditions, and if it understands the dissatisfaction with the plaintiff, the CSA considered that reactions had been formulated and that the control of the antenna by the chain had ensured.
