Objective of the must carries of audio-visual works

In order to preserve cultural diversity and to support national industry and European audiovisual programmes, the law forces on the chains quotas of diffusion of European audio-visual works and/or French original expression.

This regulation differs according to whether the television service uses or not for its distribution the frequencies assigned by the Superior council of audio-visual (hertzian chains).

The installation of the quotas of diffusion in France goes back to the Seventies. The shortly after the reform of the ORTF, the specifications of the three companies of program lately created set an objective of programming of 60% of works of fiction of French origin (or with majority French participation) to reach annually.

The quotas of diffusion, whose principle was registered thereafter in the law of September 30th, 1986, aimed initial objective to contain the progression of the fiction of foreign origin, to the detriment of the French fiction, and to thus ensure to the televiewers the right to have access to a reasonable proportion of programmes of French origin in the offer of the TV channels.

The quotas also pursued a goal of economic order while bringing a corrective measure to the policies of acquisition of the diffusers which privileged in their purchases of programs foreign works, less expensive, to the detriment of national or European works.

This competitive advantage must be moderate today, certain foreign works of fiction not being cheaper than the national productions.

The quotas of diffusion thus preserve their vocation to guarantee near the public the cultural identity works.

Presentation of the quotas of diffusion of audio-visual works

Hertzian chains

Article 13 of the decree n° 90-66, which fixes the must carries of audio-visual works of the editors of television services, provides that those must devote, in the total of the time annually devoted to the diffusion of audio-visual works, at least 60% with the diffusion of European works and at least 40% with the diffusion of works of French original expression.

The minimal proportions of 60% from European works and 40% of works of French original expression must also be respected at prime times, i.e. on the time slot understood Wednesday enters 14 hours and 18 hours and the other days between 6 p.m. and 23 hours.

The decree also envisages a derogatory mode authorizing the Superior council of audio-visual to arrange, for each editor of service diffused by terrestrial hertzian way in digital mode according to the nature of its programming, the time slot of prime times.

Services of cinema

Channel + and TPS Star, which are subjected to the same rates of obligations for European works (60%) and from French original expression (40%) profit from a specific scheme: their prime times recover a time slot going from 20:30 to 22:30.

Not-hertzian chains

Article 13 of the decree n° 90-66 fixes the must carries of audio-visual works of the editors of television services and provides that those must devote, in the total of the time annually devoted to the diffusion of audio-visual works, at least 60% with the diffusion of European works and at least 40% with the diffusion of works of French original expression.

The decree also envisages a derogatory mode authorizing the Superior council of audio-visual on the other hand to lower up to 50% the quota of diffusion of European works of commitments in the production of audio-visual works of French original expression new by independent companies of production.

The editors of television services not cinema distributed by the networks not using frequencies assigned by the Superior council of audio-visual whose audience annual average exceeds 1,5% of the total audience of the television services must also respect the minimal proportions of 60% from European works and 40% of works of French original expression at prime times, i.e. on the time slot understood Wednesday enters 14 hours and 18 hours and the other days between 6 p.m. and 23 hours.
