The Superior council of the audio-visual one,
Considering the law n° 86-1067 of the modified September 30th, 1986 relating to the freedom of communication, in particular its article 20-3;
After having deliberated on it,
The law n° 2012-158 of February 1st, 2012 aiming at reinforcing the ethics of the sport and the rights of the sportsmen modified article 20-3 of the law n° 86-1067 of September 30th, 1986 relating to the freedom of communication which lays out from now on that: “The television services which diffuse sporting programs contribute to the fight against the doping and the protection of the people practitioner of the physical-activities and sporting by diffusing programs relative on these subjects. The Superior council of audio-visual fixes the conditions for application of this article “.
The Council intends to promote a fight plan against the doping and of protection of the people practitioner of the physical-activities and sporting, which is effective as for the diffused, pragmatic message as for the diversity of the leading characteristics of the television services concerned, adapted to waitings of largest audience, and which on television takes account of the state of the information currently suggested on the subject.
For the realization of the goals pursued by the legislator and the present deliberation, the Council asks the organizations in addition intervening in the prevention and the fight against doping and in the defense of sporting ethics and the editors of television services to set up capable co-operations to promote the policy desired by the legislator.
The present deliberation has the aim of laying down the methods of diffusion of the programs concerning the fight against the doping and the protection of the people practitioner of the physical-activities and sporting.
Article 1. Field of application
The deliberation is applicable to the whole of the national services of television, free and paying, which diffuse sporting programs whatever the format of the latter.
Article 2. Methods of the contribution
2.1 Annual contribution
Each editor contributes each year to the fight against doping and the protection of the people practitioner of the physical-activities and sporting, by diffusing programs relative on these subjects.
These programs must be diffused between 6 a.m. and midnight.
The annual contribution of the editor cannot be limited to the only treatment of facts of news related to doping.
2.2 Sets of themes having to be approached over one four years period
On the whole of the period 2012-2016, the editor diversifies, as far as possible, the formats and the kinds of programs ensuring the promotion of the fight against doping and the protection of the people practitioner of the physical-activities and sporting. For that, it is based on its leading characteristics, of which:
- newspapers of general or sporting information;
- magazines of plate or images;
- the documentary ones;
- short programs;
- televisual or cinematographic fiction;
- works of animation.
It takes care to vary the schedules of diffusion of the programs evoking the problems of doping in the sport and the protection of the people practitioner of the physical-activities and sporting.
The diffused programs, subjects or reports must make it possible to the public to apprehend the medical, social and educational of doping in the sport and the protection of the people practitioner of physical-activities and sporting dimensions (methods of doping; consequences medical, physiological, psychological and social on the people who resort to it; action of the public authorities; promotion of the practices allowing to undertake a physical-activity and sporting in the respect of sporting ethics).
The editor takes care to tackle the related questions with the problems of doping and the protection of the people practitioner of the physical-activities and sporting:
- in the professional practices, amateur and school of the sport;
- while being based on the training medical, legal, sociological and technical;
- by in particular calling on the testimony of high level sportsmen.
The editor sensitizes the whole of the public to the promotion of the fight against doping and to the protection of the health of the people practitioner of the physical-activities and sporting. It adapts its contribution to the various categories of public federated by its programs, in terms of ages (adult, adolescent, children) and of practices of physical-activities and sporting (professional, amateur, associative, school).
As regards programs addressing itself to the youngest public, the contribution of the editor must be more centered on the promotion of the sports activity and the transmission of educational values, while insisting on the compliance with the rules (of the game, of the referee, etc) and by developing the physical teacher and driving role.
The editor endeavours to relay his contribution on his communications tools institutional and general public, in particular the websites and the publications intended for the subscribers as regards TV channels paying.
The Council invites the audio-visual groups editors of the services subjected to the present deliberation to associate more a large number of services published by their group with their contribution to promotion of the fight against doping and to protection of the health of the people practitioner of the physical-activities and sporting, in particular by ensuring the circulation of programs within the group, by evoking the subject of doping in their programs or by conceiving new programs.
Article 3. Implementation of the contribution and follow-up of the execution
The editor communicates each year with the Council, in his report on the conditions for implementation of his obligations and commitments for the preceding exercise, an assessment of his contribution to the fight against doping and the protection of the people practitioner of the physical-activities and sporting.
On a purely derogatory basis, the first assessment is transmitted to the month of May 2013, for the first ten months of application of this deliberation.
Article 4. Final provisions
The present deliberation will come into effect on July 1st, 2012. It could be modified on July 1st of each year within sight of the gained experience and of the quality of the exposure of the programs.
The Council will proceed to an assessment of its application in 2017.
The present deliberation will be published in the Journal officiel de la République française.
