The food charter

The food charter of the audio-visual CSA

The CSA always considered that the audio-visual one was to play all its teaching part to encourage the good behaviors, in the occurrence with regard to the food and the hygiene of life of young people. In front ofthe increasing importance of the problems of health due to obesity in France, in particular in the children, of associations, the deputies, the ministers asked the CSA to intervene. 

 Taking into account the multiplicity and complexity of the factors which support the progression of obesity, the CSA proposed the drafting and the adoption by the actors concerned ofa charter known as “food” to promote a healthy food and a regular physical activity in the programs and the advertisements diffused with television. The concern which she answers concerning the effects of the TV commercial for certain food substances on the children joined the broader problems of protection of public sensitive, one of the essential missions assigned with the Council by the law of September 30th, 1986.

A first version of the charter was signed in 2009 by the qualified ministers, the chains of television, the professional organizations interested and the CSA. One second charter was signed on November 21st, 2013. It reinforces certain commitments and account more signatories than the first. 

With the eyes of the CSA, this charter only one approach partial of the fight against obesity constitutes, but it has the virtue to be based on the dialogue between the actors within the framework of a balanced regulation. 

Commitments of the food charter

On the other hand maintenance of the legislative measures and lawful relating to food publicity into force at the day of the signature (not of suppression of the food advertisements during the diffusion of programs youth), the editors, advertisers, producers and agencies agreed to respect the commitments contained in the charter:

  • The advertisers reinforce the approach “quality” of publicity;
  • The TV channels and their advertising agencies grant tariff conditions adapted to the collective campaigns promoting the products of which it is advisable to increase consumption;
  • The TV channels are committed diffusing, in particular near the young public, of the programs relating to the good food and the physical-activity;
  • The audio-visual producers commit themselves producing short programs aiming at the young public emphasizing the food good practices and the hygiene of life;
  • The advertisers or the groupings of advertisers finance short programs of education adapted to the young public to support the good food behaviors and the physical-activity;
  • The chains are committed promoting the website

November 21st, 2013: a new charter, more ambitious

November 21st, 2013 was signed at the CSA a new food charter, which takes effect starting from January 1st, 2014 for duration a five years. Its signature took place in the presence of Aurélie Filippetti, Minister for the Culture and Transport, Stéphane Le Foll, Minister for Agriculture, the Agri-foodstuffs and the Forest, Victorin Lurel, Minister for Overseas, and Valérie Fourneyron, Minister for the Sports, Youth, Popular education and Community life. Vincent Peillon, Minister for State education, and Marisol Touraine, Minister for the social Affairs and Health, also joined the approach.

This new text aims to renew and amplify the commitments of the previous charter whose impact near the hearths was shown by an investigation of the TNS Sofres institute which stresses that “television is well located like conveying medical messages”.  

Whereas the previous charter took only account of linear television, the news understands from now on the new fashions of diffusion of television by including the websites and the television of correction.

The new charter relates to thirty-six chains against nineteen previously, it includes from now on the new chains of the DVB, overseas televisions as well as local televisions.

The requirements of diffusion of programs aiming at promoting a food and a physical-activity favorable to health were increased: whereas the first charter envisaged a total volume ranging between 340 and 470 hours, the news envisages from now on a minimum volume ranging between 587 and 753 hours.

Another notable innovation, the CSA can from now on request the opinion ofa committee of experts on the qualification of the emissions declared with the title of the food charter. The chains or the producers can also consult it.

The TV channels, the representatives of producers, advertisers and associations largely took part in this new charter which will take effect. Olivier Schrameck, president of the CSA, and Christine Kelly, president of the working group “Health and durable development”, thus managed to federate the audio-visual sector around the fight against the obesity and the prevention of the cardiovascular diseases.
