Recommendation of April 2nd, 2014 to the services of radio and television for the election of the representatives in the European Parliament May 24th and 25th, 2014

The Superior council of the audio-visual one,
 
Considering the electoral code;
 
Considering the law n° 77-729 of the modified July 7th, 1977 relating to the election of the representatives in the European Parliament;
 
Considering the law n° 86-1067 of the modified September 30th, 1986 relating to the freedom of communication;
 
Considering the decree n° 79-160 of the bearing February 28th, 1979 application of the law n° 77-729 of July 7th, 1977 relating to the election of the representatives to the European Parliament;
 
Considering the decree n° 2014-379 of the bearing March 29th, 2014 convocation of the voters for the election of the representatives in the European Parliament;
 
Considering the deliberation n° 2011-1 of January 4th, 2011 relating to the principle of political pluralism in the services of radio and television in election time;
 
After having deliberated on it,
 
Adopt the following recommendation:
 
The Superior council of audio-visual adopted on January 4th, 2011 a deliberation applicable to the services of radio and television in election time. The present recommendation supplements this deliberation for the election of the representatives in the European Parliament which will take place May 24th and 25th, 2014.
 
It applies to the whole of the services of radio and television, whatever their mode of diffusion by very proceeded of electronic communication, as from the Monday, April 14, 2014 and until the day when the election is acquired.
 
It does not apply to the services which, exclusively accessible by transportation route to the public online, are devoted to the electioneering propaganda of the lists of candidates or the parties and groupings political which support them. 
 

1. Statement of the interventions  

1° the editors raise the speaking times of the lists of candidates, the parties and groupings political and their supports:

  • in the newspapers, news bulletins, magazines of information and special programs;
  • in the other emissions of the programs;

2° raised times are cumulated since April 14th, 2014 until Friday included preceding the day by the poll, except for Saint Pierre and Miquelon, of Guyana, of Martinique, of the Guadeloupe, Saint Martin, of St. Bartholomew's Day Massacre and French Polynesia where they are cumulated until Thursday included preceding the day by the poll. 
 

2. Transmission and publication of the statements of interventions  

1° the following editors transmit each week by electronic way to the Superior council of audio-visual the calculation of the speaking times of the lists of candidates, the parties and groupings political and their supports raised in their programs:
 

  • TF1;
  • France 2;
  • France 3 for its regional national plan and its programs;
  • France 4;
  • France 5;
  • Overseas 1st (radio and television);
  • France Ô;
  • Canal+ for its programs in light;
  • M6;
  • BFM TV;
  • I>Télé;
  • LCI;
  • France 24;
  • Euronews;
  • D8;
  • RMC Discovered;
  • Number 23;
  • TV5 World;
  • Radio France (France Inter, France Info, France Culture, France Musique, France Blue);
  • Radio France international;
  • RTL;
  • Europe 1;
  • RMC;
  • BFM Business;
  • Radio operator Classic;
  • Radio operator south;
     

2° For each period mentioned hereafter, the transmission of the speaking times is carried out at the following dates:

3° For the respect of I-1 (1°) of article 2 of the deliberation n° 2011-1 of January 4th, 2011 relating to the principle of political pluralism in the services of radio and television in election time, the statements transmitted by the editors are put online on the site of the Superior council of the audio-visual one.
 

3. Obligations concerning the other editors 

The other editors communicate to the Superior council of audio-visual, with his request, all the elements relating to the interventions of the candidates, the parties and groupings political and their supports.

4. Conservation and transmission of other data elements  

The editors preserve the recordings audio and video programs diffused during the period covered by the present recommendation and communicate them to the Superior council of audio-visual when this one makes the request of it.
 
The present recommendation is applicable to French Polynesia and New Caledonia.
 
The present recommendation will be published in the Journal officiel de la République française.
