Irregular commercial communications in the series “Do not make Ci, do not do that”: intervention near France 2

The CSA drew the attention of the officials of France 2 to some practical noted in two episodes of the series Does not make Ci, does that not diffused on France the 2 February 15th and 22nd, 2017. 

The Council had indeed raised in these episodes the appearance of certain products (an over-the-counter drug and cigarette paper). It estimated that these products were clearly identifiable and that their visualization was sufficiently supported to be of an advertising nature incompatible with the prohibition of the clandestine publicity envisaged in article 9 of the decree of March 27th, 1992 relating to publicity, sponsorship, and armchair shopping. Moreover, the cigarette paper is a prohibited ingredient of publicity under the terms of the articles L. 3512-2 and L. 3512-4 of the public health code. 

In addition, the episode of February 15th comprised a pictogram informing the televiewers of the existence of a placement of product. It arises from the observations presented to the Council by the chain which no product was placed in this episode. The CSA thus drew the attention of the persons in charge of the chain to the erroneous affixing of the pictogram.

Within sight of these elements, the Council asked the persons in charge of the chain to take care in the future of the respect of their obligations.
